In early August 2023, the Indian Parliament passed the Digital Personal Data Protection Act (DPDPA), 2023. The new law is the first cross-sectoral law on personal data protection in India and has been enacted after more than half a decade of deliberations. The 2023 act creates, for the first time, a data privacy law in India. It requires consent to be taken before personal data is processed and provides a limited number of exceptions that are clearly stated in the law. It provides consumers the right to access, correct, update, and erase their data and a right to nomination
The DPDPA 2023 act creates, for the first time, a data privacy law in India. It requires consent to be taken before personal data is processed and provides a limited number of exceptions that are clearly stated in the law. It provides consumers the right to access, correct, update, and erase their data and a right to nomination. For businesses, it creates purpose limitations and obligations to provide notice of data collection and processing and mandates security safeguards. The law requires the creation of grievance redress mechanisms by businesses (Data subject access requests or DSAR’s). The Data Protection Board of India will also handle complaints and grievances and is empowered to issue penalties for noncompliance with the law.
Because of the inclusivity efforts by the govt included in the DPDPA bill 2023, legal and data compliance teams will be facing extreme volumes of vernacular data access requests and to comply with the rule of delivering all consent notices in all languages of the constitution - every single edit in your data consent draft has to be a legally accurate translation across 22 languages.
